1 Plaintiffs (Jess Willard Jacobs and Ruby L. Jacobs, husband and wife) brought this action against defendant (Burk Royalty Company, a corporation) to recover for separate items of damage to the surface of their land alleged to have resulted from defendants negligent operation of a secondary oil production project. The case was tried to a jury and a verdict was returned for plaintiffs on special interrogatories. Defendant filed a motion for new trial and this appeal is from order overruling motion for new trial.
